General Terms and Conditions

This English version is provided for your convenience. The German version is legally binding.

1. Scope and contracting party

These General Terms and Conditions apply to all orders and contracts concluded via this website. The contracting party is Natascha Schenk (Diamonds in Glass), Copacabana 38/Tür 30, 8401 Kalsdorf bei Graz, Austria (hereinafter "we"). The version available at the time of the order applies.

2. Conclusion of contract

The presentation of the products on the website does not constitute a legally binding offer but a non-binding invitation to order. By completing the order process in the checkout you submit a binding offer. The contract is concluded with our confirmation, at the latest with the dispatch of the goods. For custom creations and pieces marked "price on request" we prepare a separate quotation; in this case the contract is concluded upon its acceptance.

3. Prices and VAT

The prices stated at the time of the order apply. Prices are final prices including statutory VAT. Any shipping costs are shown separately before the order is completed. For pieces marked "price on request" the price results from the individual quotation.

4. Payment

Payment is made via the payment methods offered in the checkout. Payment processing is carried out via Shopify and the payment service providers integrated there. Unless otherwise agreed, the purchase price is due for payment upon conclusion of the contract.

5. Delivery, shipping and transfer of risk

Every piece is handmade in Graz. The production and processing time is shown in the order process and, depending on the piece, usually amounts to a few weeks. Shipping is insured; for international shipments we deliver duty and tax paid (DDP). Details can be found on the Shipping & Care page. For consumers, the risk of loss or damage passes only upon handover of the goods to you or a person named by you.

6. Retention of title

The delivered goods remain our property until the purchase price has been paid in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal of fourteen days. Details, the model withdrawal form and the exceptions, in particular for custom-made or personalised pieces, can be found in the withdrawal policy.

8. Warranty, certificate and authenticity

The statutory warranty provisions apply. Every element is individually checked for optical purity, balance and the integration of the stone before handover. A proof of authenticity with a certificate number is issued for every piece, by which its authenticity can be verified at any time.

9. Liability

We are liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. For slight negligence we are liable only in the event of a breach of essential contractual obligations and limited to the foreseeable damage typical of the contract. Mandatory statutory liability provisions, in particular under the Product Liability Act, remain unaffected.

10. Choice of law and place of jurisdiction

Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of their country of residence. The place of jurisdiction is Graz, insofar as legally permissible.

11. Dispute resolution

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not participate in them. Consumers in Austria are free to contact the Internet Ombudsstelle (ombudsstelle.at).

12. Final provisions

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of any invalid provision.
